Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Linkday app for monday.com and the linkday.app website (collectively, the "Services"), operated by Vyden ("we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Description of Service

Linkday is an app for monday.com CRM. It lets you search for business leads, score them against your ideal customer with AI, add them to your monday.com boards, and add business contact details such as work email addresses, mobile numbers and company details to rows on your boards. Contact and company data is supplied by third-party business data providers at your request.

2. User Responsibilities

You are responsible for how you use the contact data you obtain through the Services. This includes complying with the data protection, privacy and marketing laws that apply to you and to the people you contact, and honouring requests from people who ask not to be contacted. Linkday's never-contact list lets you exclude companies you must not contact from future searches and enrichment.

You are also responsible for using the Services in line with monday.com's terms and policies.

Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Services.
  • Use the Services for any illegal or unauthorized purpose.
  • Attempt to bypass any security mechanisms or rate limits implemented by Linkday or integrated third-party platforms.

3. Account & Subscriptions

  • Authentication: Access requires authentication via a supported CRM marketplace (e.g., monday.com OAuth). You are responsible for maintaining the confidentiality of your connected accounts.
  • Billing: Subscription plans and billing are managed directly through the respective CRM marketplace (e.g., monday.com billing). You are subject to their payment processing terms.
  • Credits: Each plan, including the free plan, includes a monthly allowance of credits, as shown on our pricing page. Credits reset at the start of each billing month, unused credits do not carry over, and credits have no cash value.
  • Refunds: All payments are non-refundable unless otherwise required by law or explicitly stated by the CRM marketplace billing policies.

4. Intellectual Property

  • Linkday Property: We retain all right, title, and interest in the Services, including all source code, UI/UX, and underlying technology.
  • User Property: You retain all rights to the data you synchronize into your CRM using our Services. We claim no ownership over your CRM data or the prospect data you choose to process.

5. Data Privacy

Your use of the Services is subject to our Privacy Policy, which dictates how we collect, process, and protect your data. By using the Services, you consent to our data practices as outlined in the Privacy Policy.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be error-free, secure, or uninterrupted. Because the Services depend on monday.com and on third-party data providers, changes made by those parties may temporarily or permanently disrupt Linkday's functionality. We do not guarantee that contact or company data found through the Services is complete or accurate.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VYDEN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Vyden, its partners, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms.
  • Your use of contact data obtained through the Services in breach of any applicable law.
  • Your infringement of any third-party rights.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Bhubaneswar, Odisha, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

10. Modifications & Termination

  • Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or within the application. Continued use of the Services after changes constitute acceptance.
  • Termination: We may suspend or terminate your access to the Services at our sole discretion, without prior notice, if you breach these Terms. You may terminate these Terms by uninstalling Linkday from your monday.com account. Sections 4, 6, 7, 8, and 9 shall survive termination.
